Terms and Conditions of the “Music Kingdom” Service

 

1. Terms and definitions

"SUBSCRIBER" - a person who has entered into an agreement with the OPERATOR for the provision of mobile communication services;

"OPERATOR" - LLC "COSCOM" (tm "Ucell"), providing its network for transmission or reception of information specified by the Subscriber, based on a public offer accepted by the Subscriber.

"SMS" (ShortMessageService) - a service provided by the OPERATOR to SUBSCRIBERS, allowing the latter to send and receive short text messages.

"NETWORK" - a set of technical means (switching and radio equipment, subscriber devices, connecting lines, structures, etc.) of the OPERATOR, with the help of which the SUBSCRIBER is provided with communication services on the territory of the Republic of Uzbekistan.

"SUBSCRIBER DEVICE" - the SUBSCRIBER's terminal equipment connected to the NETWORK, through which the information specified by the SUBSCRIBER is transmitted or received via communication channels.

"SERVICE NUMBER" - a short number allocated by the OPERATOR to the CONTENT PROVIDER for the provision of CONTENT SERVICES to the SUBSCRIBER.

"USER" - a Subscriber who purchases the services of the Content Provider, who has accepted the terms of this agreement by confirming his consent by sending a short message, or who has confirmed his acceptance of the terms of the agreement by pressing the confirmation key, at his own request, for a fee, uses and receives non-material services provided Content provider.

"CONTENT PROVIDER" - LLC "SDS Carrier Solutions", which has a contractual relationship with the Operator and provides services for Subscribers on the basis of an agreement with the Operator

"CONTENT SERVICE" - reference, entertainment and / or other information, melodies, pictures, videos, games, participation in polls, contests and similar events provided by the CONTENT PROVIDER to the SUBSCRIBER at the request of the latter.

"REQUEST" - a command made by the SUBSCRIBER by sending SMS, USSD, IVR voice service to the SERVICE NUMBER from the SUBSCRIBER DEVICE and / or by calling the SERVICE NUMBER from the SUBSCRIBER DEVICE, containing the command to interact with the COMPLEX to gain access to the COLLECTOR.

"TECHNICAL SUPPORT" - a set of activities carried out by the OPERATOR to provide technical support for the provision of CONTENT SERVICES by the CONTENT PROVIDER to SUBSCRIBERS, including round-the-clock operation and maintenance of the SERVICE NUMBER.

"SUBSCRIPTION" - providing the Subscriber with access to the promo quiz for a set fee within a certain period of time.

 

 

2. Terms and description

"Kingdom of Music" is a quiz based on the popular world game "Guess the melody". This fun online music test gives users the ability to guess songs on the wheel and win prizes with their music skills.

The user spins the wheel and gets random music on the wheel with points, respectively. If the user answers correctly (guesses the music or the singer in 15 seconds), he / she scores points. By continuing to play, they increase their chances of winning various prizes.

The “Kingdom of Music” quiz is not a gambling, lottery, promotional lottery or other event based on the risk of playing games and bets and is purely advertising in nature, it is held to increase subscribers' interest in additional services and to use the Operator's SMS services.

All subscribers of the operator are informed about the conduct and conditions of the Quiz through SMS or other promotion channels of the operator and content provider. In order to stimulate an increase in the interest of Subscribers to the service provided, the most active users of the services (Subscribers) who have gained the most points calculated in the manner determined by these rules will receive the prizes specified in these rules.

Operator's subscribers with any phone model (smartphones and old phones) can participate in the quiz. To activate the "Kingdom of Music" quiz, subscribers will need to send an SMS with any word (except for the deactivation keywords: STOP) to the short number 6303.

In response to his request for a subscription, the subscriber receives a free welcome SMS message with a link to the service, as well as about the rules of the quiz and subscription.

All subscribers get the opportunity to participate in the quiz for one day free of charge upon first connection.

Prizes are drawn on a monthly basis. If the results are the same, the prize is awarded to the Subscriber who completed the task the fastest, minutes and seconds are taken into account.

The quiz is provided in accordance with the order, terms, conditions and procedure provided in this document.

The Terms and Conditions of the Quiz are a public offer addressed to the Operator's Subscribers, and become an agreement between the Subscriber and the Content - Provider on the provision of the Service from the moment the Subscriber agrees with them. Subscriber's consent is considered to be connected to the service by sending an SMS message.

 

 

3. Purpose and cost

The purpose of the quiz is to draw attention to the services of “COSCOM LLC” (TM “Ucell”) by providing the Subscribers of LLC “COSCOM” (TM “Ucell”) with the opportunity to win prizes.

Subscribers of "COSCOM" LLC (tm "Ucell") can take part in the Quiz by sending an SMS with any word (except for the deactivation keywords: STOP) to the short number 6303 of the quiz (tariff cost: 1263 soums / day, including VAT).

To deactivate the service, the Subscriber must send the word STOP to 6303.

 

 

4. Language of the quiz

The quiz is provided in Uzbek (main language, default language) and Russian (language of the Subscriber's choice).

To change the language of the quiz to Russian, the subscriber must send an SMS with the keyword - RU to the short number 6303. To return to the Uzbek language, the user must send an SMS with the keyword - UZ to the short number 6303.

After changing the language, the user receives a corresponding SMS notification and the next question in the selected language.

 

 

5. Acceptance of conditions

All participants guarantee that they have carefully read and fully understand these Terms, which are publicly available on the website www.spin-uz.uz.

By sending an SMS message to the short number 6303, the participants give their full consent and full understanding of the current conditions and agree to receive SMS messages from the short number 6303 from the Operator and the Content Provider to their mobile phones.

The quiz is realized on the basis of a daily paid subscription (1263 sum / day, including VAT). The subscription to the quiz is renewed daily for a subscription fee, for which the subscriber receives an additional 150 points to win prizes and the ability to guess 21 pieces of music.

After activating the subscription, the subscriber needs to go to the spin-win.uz website, click the "Play" button and stop the wheel spinning. When the wheel stops, the selected music will play, and the subscriber must find the answer in 15 seconds and press the button with the correct answer.

The scores for correct answers vary depending on the difficulty level of the questions. Each time the wheel stops, the portal informs the subscriber about how many points the participant will receive if he answers the question correctly. For incorrect answers, the participant does not receive or lose points.

There are 7 colors on the music wheel. Under each color, there are 3 melodies (21 fragments in total). Points are awarded according to the table below:

If during the payment for a subscription to the service, the subscriber does not have a sufficient amount on the balance (1263 sum / day), then 842 sum is charged from the subscriber's balance and the subscriber receives less - 100 points and 14 melodies, if the amount on the balance is less than 842 sum, then 421 sum is charged and then 50 points and 7 melodies are awarded.

If the subscriber has answered 21 questions and wants to continue the game, he / she can send an SMS with the keyword "OK" to the short number 6303 and receive 21 more questions and 150 points. For each such request, an additional fee is charged: 1263 UZS (Uzbek sums) including VAT.

When requesting additional 150 points or 21 questions, there is also a reasonable logic for calculating payment, and if the subscriber cannot pay the full cost of the request - 1263 UZS, he / she is given the opportunity to pay partially and receive the corresponding number of questions and points: For 842 SUM, 14 questions and 100 points, for 421 SUM 7 questions and 50 points.

The service subscription fee is charged until the subscriber unsubscribes from the service or when the service is terminated.

All subscribers get the opportunity to participate in the quiz for one day free of charge upon first connection.

The funds spent by the Participants in connection with the use of the service are not refundable.

LLC "COSCOM" (tm "Ucell") and LLC "SDS Carrier Solutions" reserve the right to cancel or change the offer and these conditions at any time. Any changes take effect on the day they are posted. All publications will be published on the website www.spin-win.uz.

In the event of a dispute regarding the conditions, conduct, results and all other issues related to the service, the decisions of COSCOM LLC (TM Ucell) and SDS Carrier Solutions LLC are final, and no requirements or discussions should enter into force unless otherwise provided by law.

This agreement will remain in full force and effect as long as COSCOM LLC (TM Ucell) and SDS Carrier Solutions LLC provide the service, not taking into account the temporary suspension of the quiz for technical reasons, for example, for repairs, scheduled maintenance or upgrading.

 

 

6. Participants of the quiz

Any individuals who have reached the age of 18, who are Subscribers of prepaid tariff plans under a mobile communication service agreement with the Operator, in accordance with the quiz conditions provided for in these conditions, can become Quiz participants.

In order to create equal conditions for participation in the quiz, legal entities that are Subscribers under a mobile communication service agreement with the Operator cannot become participants in the Quiz.

The Operator and the Content Provider do not check the age of the participants, since they do not have the technical capability, therefore, they are not responsible for the actions of minors and incapacitated persons who subscribed to the service.

Persons referred to in the first paragraph of paragraph 7 have the right to participate in the quiz by sending at least one (1) SMS message to the short number 6303 during the duration of the quiz.

All employees of the Operator and the Content Provider and their first relatives (parents, children, siblings and half brothers, sisters, spouses), as well as persons who maintain commercial relations as commercial representatives, agents and / or distributors of the Operator and the Content Provider or affiliates, as well as companies hired by the Operator and the Content Provider to implement this quiz, and their employees.

If any of these people will participate in the quiz and will be the winner, then the corresponding prize will not be awarded to him in any case, but will go to the participant who meets the requirements and took the next place.

Persons who have sent an SMS to the short number of the quiz in order to become participants in the promo quiz before or after its validity are not allowed to participate in the quiz.

The service is not provided to subscribers of other mobile operators.

Anyone who does not meet the requirements or violate the requirements of these rules should not use the service and cannot claim a prize.

 

 

7. Prizes of the Quiz

The participants of the Quiz receive 150 points every day for a daily subscription fee and points for each correct answer according to the table below:

The overall rating of each Participant is made up of the points received (for daily payment and for each correct answer).

The monthly rating of each Participant is made up of the number of points received during the current month. If a user wins a monthly prize, they cannot win the monthly prize again for the next twelve months.

The following prizes will be awarded to the winners of the quiz:

Note:

* In case of a tie (two or more participants have collected the same number of points at the time of the drawing), then the winner is the one who answered the questions before everyone else, solved the problems.

* In case of the winner's refusal to receive the prize, or the impossibility or inability to contact him / her within a certain time frame, according to the official conditions, the prize will be awarded to the second winner. In the event that the second winner is unable to claim his prize, the prize will be awarded to the next winner until a Winner has been determined.

* Prizes for the service provided will not be delivered. The winner receives them at the office of the Content Provider, or at a place determined by the Content Provider.

 

 

8. Procedure for participation

To participate in the quiz, subscribers who have the right to become participants in this quiz (see paragraph 7: Participants of the Quiz) must send an SMS message with any word (except for the deactivation keywords: STOP, STOP) to the short number 6303 at any time during the quiz. After sending the first SMS message to 6303 (registration SMS), the sender will be registered in the quiz and will be considered a participant.

After the subscriber sends the registration SMS to the number 6303, he will receive an SMS notification from the short number 6303, which confirms his / her participation in the quiz and contains detailed information about the service, about the cost, about the rules for unsubscribing.

To deactivate the service, the subscriber needs to send the text: STOP to 6303

 

 

9. Tariffication

At the first connection, all subscribers get the opportunity to participate in the quiz for one day for free.

On the following days, 1263 UZS (Uzbek sums) / day, including VAT, is charged daily from the subscriber's account - the subscription fee for the quiz subscription. The service subscription fee is charged daily until the subscriber unsubscribes from the service, or when the service is terminated.

SMS sent by subscribers to the short number 6303 are free of charge.

SMS sent to the participant from 6303 as response messages or any advertising messages regarding this quiz is free.

Each paid subscription day gives the member the opportunity to earn additional points in addition to the points earned for submitting correct answers. For a daily full subscription fee (1263 sum / day), the subscriber receives an additional 150 points to win prizes and the opportunity to answer 21 questions.

10. Limiting the number of questions in the Quiz

Participants will be able to answer a maximum of twenty (21) questions of the Quiz for free in one day. If the participant has answered 21 questions and wants to continue the game, he / she can send an SMS with the keyword "OK" to the short number 6303. For a request for a new additional block of questions (21 questions) and additional 150 points, the subscriber's account will be debited 1263 UZS (Uzbek sums) including VAT.

When requesting additional 150 points or 21 questions, there is also a reasonable logic for calculating payment, and if the subscriber cannot pay the full cost of the request - 1263 UZS, he / she is given the opportunity to pay partially and receive the corresponding number of questions and points: For 842 SUM, 14 questions and 100 points, for 421 SUM 7 questions and 50 points.

 

 

11. Help and opt-out options

If a participant wants to refuse to participate in the quiz and thus no longer receive points for the prize draws, he / she can send an SMS free of charge to 6303 with one of the deactivation keywords “STOP”. In response, the user will receive an SMS confirming that his / her mobile number is no longer involved in the game.

After unsubscribing, the subscriber can reactivate the quiz by sending free SMS with any word (except for the deactivation keywords: STOP), including the answer to the last question received before unsubscribing to the service number 6303.

If the subscriber stops his subscription and then reconnects, then upon reconnection the subscription fee is charged from the day of connection.

Participants will also be able to send SMS to short number 6303 (free of charge) for the following purposes:

* Receive information about your current points by submitting the keyword "INFO".

 

 

12. Conditions of winning

A participant (owner of MSISDN) can win a maximum of one (1) monthly prize for a period of six (6) months throughout the duration of the quiz.

In order to receive an award or be eligible for it, the winners must reside in the territory of Uzbekistan. It is also a mandatory requirement that the winner, who received the award, should enter his personal data (name, surname, etc.) into COSCOM LLC (TM Ucell) and inform the CONTENT PROVIDER and the OPERATOR in writing about the receipt of the award.

The CONTENT PROVIDER and the OPERATOR reserve the right to exclude, without prior notice, all those people who use the CONTENT SERVICES in bad faith or for fraudulent purposes.

The CONTENT PROVIDER and the OPERATOR have the right to repeat the procedure for determining the winner in case of doubt and / or revealing inaccuracy in the accumulation of points by the participants participating in the drawing. Participants who took part in the CONTENT SERVICE, using unfair competition, illegal business practices, violating consumer rights and / or having performed similar actions, cannot be considered the winners of the CONTENT SERVICE.

The OPERATOR and the CONTENT PROVIDER have the right not to allow individuals who try to influence or have influenced (directly or indirectly) the procedure for collecting points in ways not specified in these Terms and Conditions to participate in the service.

Among others, the use by participation in the CONTENT SERVICE will be considered a violation:

• any equipment, except for a subscriber device, which is a mobile phone (hereinafter referred to as “mobile phone”) with the Operator's SIM card;

• any software, including those installed on a mobile phone, except for software developed by the Organizer or the Operator;

• software tools developed by the Organizer or the Operator intended for participation in the CONTENT SERVICE, converted in any way, including by interfering with the program code;

• any other ways and means of automating the process of participation in the CONTENT SERVICE.

• the Participant sends an answer to the question in less than 3 seconds

• identified patterns in the frequency of answers to questions, including the sending of answers by the Participant at regular intervals and other patterns;

• other data of the technical system used by the Organizer and the Operator for documenting the CONTENT SERVICES (logs), and the data of such a system are recognized as final and are not subject to dispute by the Participant.

In this case, the Organizer and the Operator may decide to exclude such a participant from the list of prize-winners and the prize goes to the Participant of the Quiz next in the rating of the corresponding day of the Quiz.

If the winner does not fulfill any of the previous conditions, he loses the right to win.

If the winner refuses to receive the prize or is unable to contact the CONTENT PROVIDER and / or the OPERATOR within thirty (30) days from the date of his / her winnings, the prize will be received by the participant who took the second (2) place in the corresponding list of draws / contests. This competitor will be named the second (2nd) winner. If the second (2nd) winner also refuses his prize or is unable to contact the CONTENT PROVIDER and the OPERATOR, the third (3rd) winner will receive the prize. In the event that subsequent winners cannot be obtained, the right to receive a prize passes to the next winner, until the winner is determined.

Prizes cannot be substituted for any other award.

 

 

13. Summing up the results of the Quiz, determining and informing the winners.

The winner is determined by the end of the month within 7 calendar days from the end of the winning period of the Quiz.

The company contacts the winner by calling the phone number from which they participated in the Quiz.

If it is impossible to contact the Participant within 5 days after determining the leader, due to the fact that the Participant's phone is disconnected for non-payment, is out of the service area, etc., the Contractor has the right to revise the results of the Quiz and determine the next leader in the list of points.

In case of violation by the Participants of the rules of this Regulation, the Organizations conducting the Quiz reserve the right to revise the results and, depending on the results, decide to deprive the winner of the prize and transfer the prize to the next leader in the list of points.

Once the winner is determined and in order to claim the prize, a signed Acceptance Certificate submitted by the CONTENT PROVIDER must be presented. Signing of the Acceptance Act implies that the winner accepts the conditions specified in this document, as well as all obligations that may arise to confirm the prize.

When awarding prizes, the winners of the Quiz sign a handout sheet confirming the receipt of the prize, with the presentation of the original passport. Copies of the winners' passports are attached to the handout.

A prerequisite for receiving a prize is that the Participant provides a passport with registration data within 10 days from the date of receipt of the notification of the victory. If the Participant does not provide the specified data, the Prize is not issued to the Participant, the results of the Quiz are revised.

Prizes will be awarded during or after the validity period of the CONTENT SERVICE.

The place of awarding the prize is determined by the CONTENT PROVIDER and the OPERATOR as agreed and announced to the winner by SMS or by phone.

The winner bears all travel expenses to and from the place of awarding the prize necessary for the presentation of the prize.

The content provider has the right to refuse to issue a prize to the Participant in the event of:

- violation by the Participants of the rules of this Regulation:

- failure to provide documents;

-inaction / actions of the Participant, indicating his refusal to provide the documents necessary for the presentation of the prize;

- receipt of the Participant's refusal to receive the prize, sent in writing within 30 calendar days from the end of the Quiz;

- if the Participant refuses to sign the documents on the delivery of the prize;

 

 

14. Changing the rules

The CONTENT PROVIDER and the OPERATOR reserve the right to cancel, suspend or change these Terms and Conditions, as well as the organization and / or management of this CONTENT SERVICE, without the right to compensation and without the obligation of prior notice, any such changes are brought to the attention of the public by an additional act to these terms prior to the date of amendment.

 

 

15. Protection of personal data

The CONTENT PROVIDER and the OPERATOR inform you that personal data will be processed for the purpose of participating in the CONTENT SERVICE and can be disclosed only if the Subscriber is the winner. In addition, anonymized information may be processed for marketing purposes.

 

 

16. Responsibility

The CONTENT PROVIDER is responsible for the technical serviceability of the CONTENT SERVICE and the correctness of the information used within the CONTENT SERVICE, including questions and answers.

The CONTENT PROVIDER guarantees the delivery of the prizes specified in clause 8. of these conditions to the participants identified as winners in accordance with these conditions.

In the event that, due to force majeure circumstances, the described award cannot be presented, the CONTENT PROVIDER undertakes to replace it with an equivalent one.

The CONTENT PROVIDER and the OPERATOR and, in this case, the companies participating in the CONTENT SERVICE, do not bear any responsibility for losses of any nature, direct, indirect and / or incidental, occurred or delayed, arising from or as a consequence of the use of the award.

In addition, the CONTENT PROVIDER and the OPERATOR do not bear any responsibility in the event of a situation that prevented Ucell users from participating in the competition due to technical limitations or other typical GSM services, for example: the network is busy, the phone memory is full, incorrect use of SMS services, the number specified for this service is dialed incorrectly or blocked by the subscriber device, being out of the network access zone, insufficient funds on the SIM card account, exceeding the credit limit, etc.

 

 

17. Dispute Resolution and Applicable Jurisdiction

Any disputes related to this CONTENT SERVICE must be formalized in writing.Possible disputes arising between the CONTENT PROVIDER and the OPERATOR and the participants of the CONTENT SERVICE will be resolved by peaceful negotiations or, if this is not possible, by the authorized courts of Uzbekistan.

 

 

18. Announcements

The terms of this CONTENT SERVICE are available to the public through the website www.6303.uz and / or at any of the Organizer's offices / stores.

 

 

19. Binding agreement of the participants

The winners authorize the CONTENT PROVIDER and the OPERATOR to reproduce and use their name, surname and other information, as well as their photo in any public advertising activity related to the CONTENT SERVICE, in which they are the winners, without the above use, without providing them with any or any other remuneration or benefit, except for the presentation of the received award.

Winners agree to participate in promotional interviews, photography and / or video filming for the purpose of advertising CONTENT SERVICES.

Participants can be informed by the CONTENT PROVIDER and the OPERATOR (via SMS or any other means of communication) about subsequent services outside the validity period of the CONTENT SERVICE.

All items, attachments and information included in these Terms or any other informational materials (advertising and / or presentation) related to this CONTENT SERVICE, which must be published in any media and / or on the website. on www.6303.uz at any time before or during the validity period of CONTENT SERVICES are an integral part of the CONTENT SERVICES rules.

THE OPERATOR and CONTENT PROVIDER reserve the right to terminate the service at any time without prior notice.

The OPERATOR and the CONTENT PROVIDER are not responsible for the amount of money that the participants must spend during the validity of the CONTENT SERVICE, including money illegally withdrawn from the accounts of the participants by third parties (including the disabled, partially disabled, infants or minors).

By participating in the CONTENT SERVICE, the participants hereby guarantee that all information provided to the CONTENT PROVIDER and the OPERATOR is true, current and complete.
